In October 2024, an extensive collection of assets surfaced online, including prototype designs and internal documents related to the favorite franchise. Back in August 2024, Game Freak, known for developing the mainline RPGs, acknowledged a data breach that compromised over 2,600 cases of “personal information.”
The link between this breach and what has become known as the “Teraleak” remains unconfirmed; however, Nintendo has decided to pursue action regarding the latter incident. Pokémon Legends Arceus was explicitly mentioned as one of the affected titles.
Court documents outlined by Polygon reveal that “Nintendo of America Inc., through its undersigned counsel of record, hereby requests that the Clerk of this Court issue a subpoena to Discord Inc. to identify alleged infringers at issue under the Digital Millennium Copyright Act.” The filing emphasizes that Discord is where the infringing content was posted by an account named ‘GameFreakOUT’ within a server titled ‘FreakLeak.’
The document further claims that materials disseminated by GameFreakOUT violate Nintendo’s exclusive copyright rights. This includes artwork and characters closely tied to Pokémon and explicitly points out Pokémon Legends: Arceus.
It’s important to explain that this doesn’t mean Nintendo is suing Discord itself; there’s been no indication so far whether Discord will comply with their request.
